On Monday, the U.S. Supreme Court decided not to review an appeal challenging Montgomery County Public Schools’ gender identity guidelines.
The court’s decision doesn’t necessarily mean it agrees with the lower court’s ruling. A decision to deny certiorari just means that fewer than four justices wanted to review the case.
According to court documents, three parents with children in MCPS challenged the school district’s right to withhold information from parents about gender support plans developed for students.
The parents alleged the policy “unconstitutionally usurps the parents’ fundamental right to raise their children under the Fourteenth Amendment.”
The lower court ruled that the parents did not have standing as they failed to allege that their children have gender plans from MCPS, are transgender or struggle with their gender identity.
